GENERAL
1 - all advertisements accepted for publication by Coolmarket in any of it's printed or online publications are accepted subject to these terms & conditions.
Any other conditions proposed by the seller will be void unless accepted by Coolmarket in writing.

2 - In these conditions:
“Seller” means the person placing an advert for an item they have for sale. “Medium” means the publication - printed or online- taking the booking. “Potential buyer” means the person enquiring through Coolmarket about an item for sale. “Adverts” means display, online, email and classified advertising and shall include inserts, supplements and re-directed advertisements. "Buyer" means a person who has secured an item with a deposit or who has paid for an item in full. "Item" is the vehicle, coldstore, piece of equipment or part that is advertised for sale on Coolmarket

3 - all adverts are accepted subject to space being available in the medium at the time

4 - Coolmarket reserves the right to cancel any order without liability in the event of becoming aware of any meetings of creditors, bankruptcy, liquidation proceedings, the appointment of a receiver or administrative receiver over the whole or substantial part of the sellers assets, or any indication whatsoever of financial difficulties.

5 - these conditions and all other express terms of the contract between Coolmarket and the seller shall be governed and construed in accordance with the laws of England and the parties hereby submit to the non-exclusive jurisdiction of the English Courts.

LIABILITY
We will need to carry out routine maintenance and servicing of our servers and equipment from time to time. While we will seek to keep disruption to a minimum we cannot guarantee that the Website will be continuously available on-line. We therefore provide the Website on an "as is" and "as available" basis.

We make no warranty that the Website is free from computer viruses or any other malicious or impairing computer programs. It is your responsibility to ensure that you use appropriate virus checking software.

We are not liable for any failure to perform any of our obligations under these terms and conditions caused by matters beyond our reasonable control.

We shall not be liable for any damages, including without limitation, direct, indirect or consequential damages, howsoever arising out of your use of the Website or in respect of any of your actions or omissions taken in reliance on any of the advice or information contained on the Website or any website to which the Website is linked.

Nothing in these terms and conditions limits our liability for death or personal injury resulting from our negligence.

OWNERSHIP
Copy must conform to Coolmarket’s requirements and Coolmarket reserve the right to charge for any additional work involved in amending the copy of the advert to conform to it’s requirements.

All rights, including copyright, in the content of coolmarket.co.uk and in the photographs of any items displayed on the Website and all database rights, are owned or controlled for these purposes by us.

All trade marks, names, and logos are the proprietary marks of us or of our associated companies. Marks identifying third parties are owned or licensed by those third parties or their associated companies. Nothing in these terms and conditions in any way confers on you any licence or right under any trade marks, names or logos.

You may not copy, reproduce, redistribute, download, republish, transmit, display, adapt, alter, create derivative works from or otherwise extract or re-utilise any of the contents of this Website. In particular, you must not cache any of the contents for access by third parties nor mirror or frame any of the content of the Website nor incorporate it into another website without our express written permission.

MINIMUM ORDER
While Coolmarket is committed to supplying the quantities you need, third party sales may be subject to minimum order quantities.

CUSTOMS AND IMPORT DUTIES
Coolmarket does not collect import duties or customs taxes and has no knowledge of what these charges may be. If you are responsible for these additional charges, you will be required to pay them in order for your package to clear customs. For more information regarding your country's custom policies, contact your local customs office.

We are happy to manage export sales. Please contact us to set up an account or for further information.

USED VEHICLES & EQUIPMENT
All used vehicles are Sold As Seen unless otherwise agreed in writing. Used vehicles and Equipment may not be sold with manuals, spare keys, spare wheels, wheel braces or jacks.

SELLING (VEHICLES AND COLDSTORES) COOLMARKET SALE
Coolmarket to sell on sellers behalf; No Sale-NO fee. All negotiations will be carried out by Coolmarket. Sellers will have no enquiries directly from potential buyers. Advert display will be up to five photos and a maximum of 30 words. The minimum acceptable price should reflect the current trade value of the item. Coolmarket will advise the seller of the current value of the item at the time of advertising. Coolmarket will purchase the item as a Trade Sale from the seller, unless otherwise agreed in writing, the fee is added to give the selling price which should not exceed the current retail value of the vehicle. The fee will be determined by Coolmarket and will be Coolmarket's commission for the Sale. Coolmarket will negotiate with potential buyers, no lower than the sellers Minimum acceptable price, unless agreed with the seller in writing. If we do not find a buyer, there is no fee. Your items will usually be displayed on the site within 24hours of receipt of your written confirmation to advertise, the full details of the item (including damage and defects) and photos showing all sides, internal and external. The seller is responsible for supplying Coolmarket with correct details of the item for sale. The seller is responsible for advising Coolmarket if the item is no longer for sale or if the seller no longer wishes for the item to be displayed.


PAYMENT DETAILS (VEHICLES AND COLDSTORES) - COOLMARKET SALE
When Coolmarket have a definite interested party agreed for the purchase of the item, we will take a deposit from the buyer.Vehicles will not be withdrawn from sale until a deposit has been received. Upon completion Coolmarket will agree the commission and balance due and either refund or collect the difference from the seller. Once the seller and Coolmarket have received cleared funds of a deposit this will form a binding contract.


BUYING USED VEHICLES AND EQUIPMENT
All items are sold as seen. A vehicle is only reserved for a buyer once Coolmarket have received cleared funds of the deposit or payment in full, whichever is agreed.It is the buyers responsibility to ensure the vehicle is accurate for their requirments. Coolmarket therefore recommend that buyers view used vehicles prior to purchase. It is the buyers responsibility to keep up to date and abide by the current vehicle licensing laws. Once the buyer agrees to buy an item, agreement to purchase and request for an invoice is required in writing.  An invoice must be paid upon receipt of the invoice, unless otherwise agreed in writing by Coolmarket. Items are not held unless paid for in full or secured with a deposit, unless otherwise agreed in writing by Coolmarket.

SHIPPING
Coolmarket does not provide shipping for items. Shipping should be arranged by the buyer, unless otherwise agreed with Coolmarket. If the buyer requires Coolmarket to arrange the shipping on their behalf, an admin fee of £300 will apply. Insurance of the vehicle during shipping is to be arranged by the buyer.

DELIVERY
Delivery is not included in any prices shown on Coolmarket.co.uk unless stated. Delivery can be arranged by Coolmarket to any UK mainland destination, price on application

Membership rates and pricing details will be laid out in the Sellers Guide once testing on this part of the site is complete.

CARRIAGE - PARTS SALES
All carriage costs will be determined at the point of sale.

CANCELLATION
1. Cancellation or suspension of the advert by the seller must be received in writing by Coolmarket within the period specified
2. Coolmarket reserves the right to omit or suspend an advert at any time for good reason, without liability to the buyer and shall notify the buyer as soon as possible. If such omission or suspension is due to the act of default of the Seller or their agents, then the seller shall pay for the advert in full notwithstanding that the advert has not been published
